1. About these terms

These Terms & Conditions govern your use of our website (platinumcosmeticskin.com.au), your purchase of our services and products, and your relationship with Platinum Cosmetic Skin Clinic. Please read them carefully. Our Booking Policy and Privacy Policy also form part of these terms, and by booking with us, buying from us, or using our website, you agree to all of them.

If you do not agree with these terms, please do not use our website or services.

2. About us

Platinum Cosmetic Skin Clinic is operated by Platinum Ko Pty Ltd (ABN 91 692 929 730). We provide clinician-led, non-surgical cosmetic, skin, beauty and cosmetic tattoo services from our clinics in Hawker (ACT) and Queanbeyan (NSW).

3. Our services

All cosmetic aesthetic and clinical treatments are provided by qualified practitioners. Some treatments require a consultation and individual assessment before they can be performed, and treatment is never guaranteed – suitability is always assessed on a case-by-case basis having regard to your health, history and goals.

Our practitioners reserve the right to decline or modify any treatment where, in their professional judgement, it is not safe or appropriate for you. Further detail is set out in our Booking Policy.

4. Eligibility and your responsibilities

To book and receive treatment with us, you agree that:

  • you are 18 years or over for any cosmetic injectable treatment, and you will provide photo identification on request;
  • the information you give us – including your medical history, medications, allergies and any changes to your health – is true, accurate and complete; and
  • you will follow the pre-care and aftercare guidance provided by your practitioner.

Providing incomplete or inaccurate health information may affect the safety, suitability and outcome of your treatment.

5. Bookings, deposits and cancellations

Bookings, deposits, cancellation notice periods, fees, late arrivals, gift certificates and treatment packages are governed by our Booking Policy, which forms part of these terms. In summary, we require a minimum of 48 hours’ notice to cancel or change an appointment, a $100 cancellation fee applies to late cancellations and no-shows, and a $100 deposit is required for selected higher-value treatments.

6. Pricing and payment

All prices are in Australian dollars and include GST where applicable. Prices are subject to change at any time, and the price that applies is the price quoted to you at the time of your consultation or purchase.

Consistent with the Therapeutic Goods Advertising Code, we do not publish pricing for prescription-related cosmetic injectable treatments on our website; your practitioner will quote the full cost of treatment transparently during your consultation. Payment is required at the time of treatment or purchase unless otherwise agreed in writing.

7. Promotions and discounts

From time to time we offer promotions, discounts or special offers (for example, a first-visit discount). Unless stated otherwise, offers cannot be combined with any other offer, are subject to availability, apply only for the period advertised, and may be varied or withdrawn at any time. Any specific conditions stated with an offer apply.

8. Online shop and product purchases

Products purchased through our online store are subject to availability. We take reasonable care to ensure product descriptions, images and prices are accurate, but errors may occasionally occur; where we discover an error affecting your order, we will contact you to confirm or cancel it.

Title to and risk in products passes to you on delivery. We do not offer refunds for change of mind on retail products. This does not limit your rights under the Australian Consumer Law (see section 12).

9. Treatment outcomes

Cosmetic and skin treatment outcomes vary from person to person and depend on factors including your skin, your health, and how you follow aftercare guidance. While our practitioners take great care to help you achieve your goals, we cannot and do not guarantee any specific result. Any timeframes or outcomes discussed are estimates only and not a promise of a particular result.

10. Information on our website is not medical advice

Information on our website and in our communications is general in nature and is provided for information only. It is not medical advice and is not a substitute for a consultation with a qualified practitioner. Always seek advice tailored to your circumstances before deciding on a treatment.

11. Your privacy

We handle your personal and health information in accordance with our Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth), the Health Records (Privacy and Access) Act 1997 (ACT), and the Health Records and Information Privacy Act 2002 (NSW). 12. Australian Consumer Law

Our services and products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

For major failures you are entitled to the remedies provided under the Australian Consumer Law. For failures that do not amount to a major failure, you are entitled to have problems with a service or product remedied within a reasonable time and, if this is not done, to a refund or compensation as provided by law.

13. Limitation of liability

To the extent permitted by law, and subject to section 12, our liability for any failure to comply with a consumer guarantee (other than a guarantee that cannot be limited) is limited, at our option, to resupplying the service or product, or paying the cost of having the service or product resupplied.

To the extent permitted by law, we are not liable for any indirect, special or consequential loss arising out of or in connection with your use of our website, services or products.

14. Intellectual property

All content on our website – including text, images, logos, branding, graphics and design – is owned by or licensed to Platinum Ko Pty Ltd and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use our content for commercial purposes without our prior written permission.

15. Acceptable use of our website

You agree to use our website lawfully and not to misuse it, including by attempting to gain unauthorised access, introducing malicious code, or using it in any way that may damage, disable or impair the website or interfere with another person’s use of it.

16. Third-party links and platforms

Our website includes links to, and integrations with, third-party platforms – including our online booking provider (Timely), our online store, and our social media pages. We are not responsible for the content, products or practices of third-party websites. Your use of those platforms is governed by their own terms and privacy policies.

17. Changes to these terms

We may update these terms from time to time to reflect changes in our practices or legal obligations. The current version will always be available on our website, with the “Last updated” date shown at the top. Your continued use of our website or services after any change means you accept the updated terms.

18. Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia. You and we submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and, where relevant to our Queanbeyan clinic, New South Wales.
